1. ACCEPTANCE OF TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Project Outcast ("we," "our," or "us"), governing your access to and use of the SPECTRA platform located at spectra.projectoutcast.com (the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Service.

2. DESCRIPTION OF SERVICE

SPECTRA is a free, web-based open-source intelligence (OSINT) platform that enables users to analyze publicly available information from social media platforms, including but not limited to Instagram and Twitter/X. The Service provides tools for:

  • Analyzing public social media profile data.
  • Discovering publicly associated email addresses.
  • Checking emails against known data breach databases.
  • Searching for matching usernames across public platforms.
  • Mapping publicly geotagged content.
  • Analyzing publicly available posting patterns, sentiment, and engagement data.
  • Generating downloadable intelligence reports.

The Service retrieves and processes only publicly available data. It does not access private, protected, or restricted content.

3. ELIGIBILITY

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. ACCEPTABLE USE POLICY

4.1 Permitted Uses

The Service is intended for lawful and ethical purposes only, including but not limited to:

  • Legitimate security research and threat assessment.
  • Journalistic investigation and fact-checking.
  • Legal and compliance investigations conducted by authorized professionals.
  • Personal security assessments (e.g., auditing your own digital footprint).
  • Academic and educational research.
  • Corporate due diligence and background verification.

4.2 Prohibited Uses

You agree not to use the Service for any of the following purposes:

  • Stalking, harassing, threatening, or intimidating any individual.
  • Any activity that violates applicable local, state, national, or international law or regulation.
  • Attempting to access private, protected, or non-public content or accounts.
  • Facilitating identity theft, fraud, extortion, or blackmail.
  • Discriminating against individuals based on race, gender, religion, national origin, sexual orientation, disability, or any other protected characteristic.
  • Conducting unlawful surveillance or monitoring of individuals.
  • Violating the terms of service of any third-party platform, including Instagram, Twitter/X, or any other social media service.
  • Reselling, redistributing, or commercially exploiting data obtained through the Service without authorization.
  • Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service.
  • Interfering with or disrupting the Service, its servers, or connected networks.
  • Using automated scripts, bots, or scrapers to access the Service in a manner that exceeds reasonable use.
  • Circumventing any security measures, rate limits, or access controls implemented by the Service.

We reserve the right to determine, in our sole discretion, whether your use of the Service violates this Acceptable Use Policy.

5. USER RESPONSIBILITIES

You are solely responsible for:

  • Ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction, including but not limited to the Computer Fraud and Abuse Act (CFAA), the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), the UK Data Protection Act 2018, and all applicable anti-stalking and harassment laws.
  • Verifying the accuracy and legality of any information obtained through the Service before relying on it or taking action based on it.
  • Obtaining any required legal authorization before conducting investigations on individuals or organizations.
  • Any consequences arising from your use of the Service, including any actions taken based on information obtained through the Service.

6. THIRD-PARTY CREDENTIALS

Certain features of the Service may require you to provide third-party platform credentials, such as Instagram session IDs or Twitter/X authentication tokens. By providing these credentials, you represent and warrant that:

  • You are the rightful and authorized owner of the credentials you provide.
  • You understand and accept the inherent risks of providing credentials to any third-party service.
  • You acknowledge that the use of your credentials through the Service may result in your account being flagged, restricted, or suspended by the respective platform, and that we bear no responsibility for such actions.

We use your credentials solely to perform the lookups you request. Credentials are processed in server memory only and are never written to persistent storage, logged, or shared with any third party. We strongly recommend using a dedicated research account rather than your personal account.

7. THIRD-PARTY PLATFORMS AND DATA

The Service retrieves data from third-party social media platforms and public data sources. You acknowledge and agree that:

  • We are not affiliated with, endorsed by, or partnered with Instagram, Meta, Twitter/X, or any other third-party platform.
  • Third-party platforms may change their APIs, terms of service, or data availability at any time without notice, which may affect the Service's functionality.
  • We are not responsible for any service disruptions, data unavailability, or changes caused by third-party platforms.
  • Data retrieved from third-party sources is provided "as-is" and we make no guarantee regarding its accuracy, completeness, timeliness, or reliability.
  • You are independently responsible for complying with the terms of service of any third-party platform.

8. INTELLECTUAL PROPERTY

The Service, including its design, code, user interface, branding, and all associated intellectual property, is owned by Project Outcast and is protected by applicable copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose in accordance with these Terms. This license does not include the right to modify, distribute, sell, or create derivative works based on the Service.

Data retrieved through the Service may be subject to the intellectual property rights of third parties. You are responsible for ensuring that your use of any retrieved data complies with applicable intellectual property laws.

9. DISCLAIMER OF WARRANTIES

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that:

  • The Service will function uninterrupted, be error-free, or be secure.
  • The results obtained through the Service will be accurate, reliable, or complete.
  • Any errors or defects in the Service will be corrected.
  • The Service will meet your specific requirements or expectations.
  • The Service will be available at all times or in all jurisdictions.

The Service should not be used as the sole basis for any decision with legal, financial, personal, or professional consequences. You are solely responsible for independently verifying all information.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Project Outcast, its owners, operators, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.

This limitation of liability applies to, without limitation, damages arising from:

  • Your use of or inability to use the Service.
  • Any inaccuracy or incompleteness of data retrieved through the Service.
  • Any actions taken by you or third parties based on information obtained through the Service.
  • Unauthorized access to or alteration of your data or credentials.
  • Third-party platform API changes, outages, or restrictions.
  • Your violation of any third-party platform's terms of service.
  • Any suspension, restriction, or banning of your third-party platform accounts.

Since the Service is provided free of charge, our total aggregate liability for any claim arising under these Terms shall not exceed zero dollars ($0.00 USD).

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Project Outcast, its owners, operators, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Your violation of any third-party rights, including privacy rights and intellectual property rights.
  • Any claim that your use of the Service caused damage to a third party.
  • Your provision of false, misleading, or inaccurate information.

12. SUSPENSION AND TERMINATION

We reserve the right, at our sole discretion, to restrict, suspend, or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to a violation of these Terms or the Acceptable Use Policy.

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. The following sections shall survive termination: Acceptable Use Policy, User Responsibilities, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Project Outcast operates, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction.

You agree that any legal action or proceeding related to your use of the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

14. EXPORT CONTROLS AND SANCTIONS

You agree not to use the Service in violation of any applicable export control laws, trade sanctions, or embargo regulations. You represent that you are not located in, under the control of, or a national or resident of any country subject to comprehensive sanctions, and that you are not on any restricted party list maintained by any government authority.

15. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, government actions, pandemics, third-party platform outages, internet service disruptions, or cyberattacks.

16. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

If you do not agree with the revised Terms, your sole remedy is to discontinue use of the Service.

17. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Project Outcast regarding your use of the Service. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and us regarding the Service.

19. NO WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
